These Terms and Conditions govern your use of the website "https://www.binaryguard.ca" (the “Site”) and the purchase, installation, and use of security cameras, alarm systems, monitoring services, and related products and services provided by [Your Company Legal Name], a company registered in [Province], Canada (“we,” “us,” or “Company”).

By placing an order, using our services, or connecting your QuickBooks Online account, you agree to these Terms and Conditions.

1. Products and Services

  • We sell and install security cameras, alarm systems, access control, and related equipment.
  • We offer optional cloud video storage and professional monitoring services.
  • All equipment remains our property until fully paid. Title passes to you upon final payment.

2. Pricing and Payment

  • Prices are in Canadian dollars (CAD) and exclude applicable taxes unless stated otherwise.
  • We use the QuickBooks Online API to generate invoices and accept payments. By paying an invoice created through our Site, you authorize the charges.
  • Recurring monitoring fees are billed monthly or annually in advance. No refunds for partial months.
  • Late payments may incur a 2% monthly interest charge and possible suspension of monitoring.

3. Installation

  • Installation appointments are scheduled in good faith but may be delayed due to weather, supply chain, or emergencies.
  • You must provide safe access and working power/internet at the installation location.
  • We are not responsible for cosmetic damage to walls/ceilings unless caused by gross negligence.

4. Monitoring and Cloud Storage (if purchased)

  • Monitoring is provided 24/7 by our Canadian central station partner.
  • In case of alarm, we follow your pre-approved call list. We are not liable if no one can be reached.
  • Cloud video is stored encrypted for 30 days (or as per your plan). After that it is automatically deleted.
  • We may access footage only for technical support or with your written consent, except when required by law enforcement with a valid court order.

5. Warranty

  • Equipment carries the original manufacturer’s warranty (typically 2–3 years).
  • Labour is warranted for 12 months from installation.
  • Warranty is void if equipment is tampered with, improperly powered, or damaged by lightning, flood, or misuse.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY CANADIAN LAW, WE ARE NOT LIABLE FOR:

  • Indirect, incidental, or consequential damages (including loss of property, life, or business interruption).
  • Failure of the system due to internet/power outage, cellular failure, or acts of God.
  • Any amount greater than the total fees you paid us in the previous 12 months.

7. Privacy and QuickBooks Integration

Your data is handled according to our Privacy Policy and End User License Agreement. By connecting QuickBooks Online, you authorize us to create and send invoices and sync customer/payment data on your behalf.

8. Termination

  • You may cancel monitoring with 30 days written notice. Equipment remains your property (if fully paid).
  • We may terminate or suspend services immediately for non-payment or misuse.

9. Governing Law

These Terms are governed by the laws of the Province of [Your Province] and the federal laws of Canada. Any disputes will be resolved in the courts of [Your City/Province].
